Abstract

The construction of the Trans-Sumatra Toll Road is part of the national infrastructure development policy that requires large-scale land acquisition. This land acquisition process often leads to agrarian conflicts between the government and land-owning communities. These conflicts are not only related to agrarian legal issues but also affect the execution of infrastructure development contracts involving cooperation between the government and business entities. This study aims to analyze the agrarian conflicts in the land acquisition process for the Trans-Sumatra Toll Road development from the perspective of agrarian law and contract law. The research uses a normative legal research method with a legislative approach and a conceptual approach. The legal materials used include regulations, legal books, journal articles, reports from state institutions related to land acquisition, and infrastructure development. The findings show that agrarian conflicts in the Trans-Sumatra Toll Road development appear in the form of land compensation disputes, customary land conflicts, land status disputes in forest areas, and deviations in the land acquisition process. These conflicts reveal a mismatch between agrarian law norms and land acquisition practices in infrastructure development. Agrarian conflicts also have implications for the legal certainty of toll road construction contracts, as delays in land acquisition can affect project implementation schedules and business entity investment calculations. This study highlights the need for synchronization between agrarian law and infrastructure development contract law so that toll road construction can proceed effectively without causing agrarian conflicts in society.
