PERLINDUNGAN HUKUM TERHADAP KORBAN TINDAK PIDANA PENIPUAN YANG MENGATASNAMAKAN E COMMERCE
Abstract
Most people have switched from shopping in conventional markets to shopping online through e-commerce or marketplaces. In the midst of an all-sophisticated technological condition, all needs can be met through e-commerce, because almost all primary and secondary human needs are available in it. Legal protection efforts are needed for consumers who are harmed or experience fraud with the aim of fulfilling their rights as consumers and business actors are obliged to carry out their obligations in accordance with applicable laws and regulations. This study aims to find out about victims of criminal acts entitled to legal protection and find out about legal remedies that can be taken by victims of criminal acts in the name of e-commerce. This study uses a normative juridical research method (ststutta approach). The results of this study are that first, legal protection for victims of criminal acts of E-commerce fraud is regulated in Article 28 of Law No. 8 of 1999 concerning consumer protection and article 28 paragraph (1) of the Electronic Information and Transaction Law. Second, legal remedies for victims of criminal acts in the name of E-Commerce are regulated in the Consumer Protection Act in Article 45 of Law Number 19 of 2016 concerning Consumer Protection.
